In the wake of the California Supreme Court's decision in Dynamex and the enactment of AB 5, many businesses have begun to rethink the prevalent use of "independent contractors." While it is widely known there are administrative, tax, and insurance consequences of misclassifying employees, many business owners fail to appreciate that serious criminal consequences exist as well.
